Terms & Conditions — GameDay Songs

1. Introduction

These Terms & Conditions (“Terms”) govern your use of the GameDay Songs website and mobile web app (collectively, “the Service”) operated by Game Day Songs, LLC (“we,” “us,” or “our”). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

2. Eligibility & Account

You must be at least 18 years old, or have permission from a parent or guardian, to create an account. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to provide accurate information and keep it updated.

3. Acceptable Use

You agree not to misuse the Service. Prohibited conduct includes, but is not limited to:

• Using the Service for any unlawful purpose or in violation of any applicable law
• Uploading, sharing, or playing content that infringes intellectual property rights or is abusive, hateful, or harmful
• Attempting to reverse engineer, scrape, or interfere with the Service’s operation or security
• Using the Service to send spam or commit fraud
• Circumventing any access controls, plan limits, or technical restrictions

4. Subscription, Payment & Billing

GameDay Songs offers subscription plans to access the Service. Payments are processed by our online reseller, Paddle.com. Paddle is the Merchant of Record for all orders and provides customer service, billing, tax, and returns handling.

By subscribing, you agree to pay the recurring fees disclosed at checkout. Subscriptions automatically renew unless canceled. You may cancel your subscription at any time through your account or Paddle’s customer portal. When you cancel, you retain access through the end of your current billing period.

5. Intellectual Property

All content, software, designs, logos, and branding included in the Service are owned by Game Day Songs, LLC or its licensors and are protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for your personal or team use in accordance with these Terms.

6. Service Availability

We do not guarantee that the Service will be uninterrupted, error-free, or available at all times. We reserve the right to modify, suspend, or discontinue features for maintenance, updates, or other reasons. We will try to give reasonable notice for significant changes.

7. Termination & Suspension

We may suspend or terminate your access to the Service at any time, without notice, for conduct that violates these Terms, creates security or fraud risks, involves non-payment, or otherwise harms the Service or other users. You may terminate your account by deleting it within the app or contacting us.

8. Disclaimer of Warranties

The Service is provided “as is” and “as available,” without warranties of any kind, either express or implied. To the fullest extent permitted by law, we disclaim all warranties, including merchantability, fitness for a particular purpose, and non-infringement.

9. Limitation of Liability

To the fullest extent permitted by law, Game Day Songs, LLC shall not be liable for indirect, incidental, special, consequential, or punitive damages, including lost profits or data, arising from your use of the Service. Our aggregate liability is limited to the amount you paid for the Service in the 12 months preceding the claim.

10. Governing Law

These Terms are governed by the laws of the State of Ohio, United States, without regard to conflict of laws principles. Any disputes arising from these Terms or the Service will be resolved in the courts located in Ohio.

11. Changes to These Terms

We may update these Terms from time to time. We will post the updated version and revise the “Last updated” date. Continued use of the Service after changes means you accept the updated Terms.
